• These terms and conditions sets forth the terms and conditions under which the company BitsLab (ABN 11 961 735 431) of Fcty 31 3 Box Road. Caringbah NSW 2229 (BitsLab, we, or us) governs your use of our website located at www.bitslab.com.au (the Site), and the BitsLab Members platform made available through the Site and the information, content, features and services provided through the Site (together with the Software, collectively, the Service)

By using the Site and/or the Service or purchasing one of our Memberships, you agree to these Terms and Conditions. Your acceptance of these terms constitutes a binding agreement, including any modifications that Bitslab may make from time to time.

• If you do not agree to these terms and conditions, you may not use the BitsLab Site or the Service.

• BitsLab may Amend the terms and conditions which may result in changes to the website and any goods or services or promotions that it offers. Amendments are effective when they are updated on the website and any members of BitsLab or users of the website, goods or services agree to and are bound by those changes.

• BitsLab may make changes to the Site and/or the Service at any time. You understand that BitsLab may discontinue or restrict your use of the Site and/or the Service for any reason or no reason with or without notice.

• BitsLab employees, directors, managers and their respective immediate family members (i.e., parents, spouses, domestic partners, siblings and children) or any other person residing in the same household as an BitsLab, employee, director or manager may not take part of or win any giveaway or promotion within the BitsLab site or service platform.

Privacy Policy

• By using www.bitslab.com.au, purchasing a membership and using our platform or entering one of our giveaways, you represent that you have read and fully consent to our Privacy Policy, in addition to these terms and conditions.

• BitsLab may revise the Privacy Policy at any time, in which the new versions of the policy will be posted on the Site. If at any point you do not agree to any portion of the Privacy Policy, you must immediately stop using the BitsLab Site and/or the Service.

• BitsLab is bound by and obtains, uses and disseminates information in accordance with the Privacy Act 1988 (Cth)

Bits Lab Services

• The BitsLab Site is a membership rewards platform that offers its members discounts at Sim Racing, Gaming and Tech related brands and businesses across Australia. Membership also allows access to purchase BitsLab merchandise.

• Members receive access to the Site’s member’s dashboard where they can utilise the discounts on offer and manage all their payments depending on what package they have and update details as needed.

• BitsLab reserves the right to change, modify, substitute, add, suspend, or discontinue any portion of the Service, in its sole discretion, at any time. Your use of the Site and/or the Service, including the availability of new services through the Site, shall be always subject to these terms and conditions.

• BitsLab may also limit or restrict any access to or use of any goods or services, including the website, at its sole discretion without notice, at any time. 

Bits Lab Terms Of Use

• BitsLab operates the Site and the Service in Australia. Any person who chooses to access the Site, and / or the Service from a location(s) outside of Australia must do so on their own accord and are fully responsible for compliance with their any and all applicable local laws.

• All users are solely responsible for any violation of the terms of use and of any relevant laws or third-party rights as a result of their conduct, and you indemnify BitsLab for any loss or damage suffered in connection with any violation, including all of its employees, and directors.

• All communications, feedback, suggestions, comments, and submissions with BitsLab in connection with any use of the Site or any goods or services will become the exclusive property of BitsLab.

• You agree that in using any services or goods in connection with the BitsLab and it’s Site that you will not; (i) violate any applicable law or regulation, including any infringement of copyright, trademarks or improperly use, obtain or disclose confidential or private information; (ii) participate in any, harmful, defamatory or inappropriate conduct towards any person or entity; or (iii)participate or be knowingly involved in, directly or indirectly with, any breach or attempted breach of any security of the confidential or private information held by BitsLab, including any account holder’s information or software data.

As a requirement, all winners who are BitsLab members must provide photo evidence upon receiving their prize. In the event of a request, BitsLab may present this photo evidence to the appropriate commissions. BitsLab also reserves the right to use these photos under the Previous Winners section of the website.·

A Daily Giveaway is a promotion that is held on a particular day. BitsLab strives to organize a giveaway every working day from Monday to Friday. However, if BitsLab has not advertised a giveaway for a specific day, it means that it is not hosting a giveaway on that day, and this is at the discretion of BitsLab. It is important to note that usually, there are no daily giveaways on Saturdays and Sundays. Nonetheless, BitsLab may choose to have additional giveaways on these days at its discretion, and will inform the public accordingly.

Our promotions and giveaways are only valid for Australian residents whom are 15 years of age or older, and have fulfilled all requirements for the promotional giveaway. Prizes over $3000 not available to ACT customers.

Prizes will be awarded to winners of the giveaways. Physical prizes will be shipped to addresses within Australia, with all postage paid, within 14 days of confirmation. However, Australian winners who require shipping outside of Australia may have to pay for shipping charges. Virtual prizes will be delivered to the email account affiliated with the winners’ BITSLAB account. Cash prizes, on the other hand, will only be sent electronically. If you win a cash prize, BitsLab will contact you and request your bank details to facilitate the electronic transfer of the prize money.

All BitsLab giveaways are conducted in accordance to state laws, and operate within their boundaries. Any licenses required to be attached to a specific giveaway will be done as such on the giveaway description and conditions. If a specific giveaway should have a license attached to it by requirement of a specific state or territory, and does not, then that giveaway is not applicable to that state, as it does not have the required licence to be run in that state.

Exclusions, terms and conditions that are not stated here may be giveaway specific, and as such will be noted on the specific giveaway.

Each promotional giveaway has an entrant cap / limit, this is inclusive of all existing and new members that have a one off pack or an active membership during the giveaway’s stipulated time frame.

If the Entrant Limit is reached during that specific Promotion Period then that specific Promotion Period will be deemed to have closed at the time the latest entry is received and no further entries will be accepted.

Partners

As a paid member of BitsLab, you may have access to Third Party Products, services, and discounts through the BitsLab website and platform. However, it is important to note that any services, content, information, and products belonging to third party providers that may be available, advertised, or featured on the BitsLab website or in any communications are provided without any representation or warranty by BitsLab. BitsLab does not take responsibility and assumes no liability for any Third-Party services, products, or discounts. It is important to refer to the applicable terms and policies of the third parties that offer them.

User Accounts and Registration

As a part of the BitsLab member registration process, you will be required to provide your name, address, email address, and other relevant information, as well as select a password. You agree to provide accurate, current, and complete information while creating an account. Failing to do so will result in a breach of the terms and conditions, which may lead to the termination of your account.

When creating an account, it is prohibited to do the following: (a) Choose or use an email address or username that belongs to someone else with the intention of impersonating that person. (b) Use a name that is protected by someone else’s rights without their permission. (c) Use an email address or username that is indecent, offensive, or otherwise unsuitable. (d) Allow anyone else to use your account and/or password except as described here.

All memberships, rights, and associated property are personal and non-transferable

• It is important that you notify BitsLab immediately at [email protected] if you suspect or know of any unauthorized use, access to your account, or any breach of security, including the loss, theft or unauthorized disclosure of your password. Please note that you are responsible for all activities that occur under your account, even if you did not perform them. BitsLab is not responsible for any loss or damage resulting from your failure to maintain the confidentiality of your account.
  
  

One Off Member Plans

BitsLab offers one-time memberships to its customers, providing them with timed access to the rewards platform for a specific duration. The memberships are available in different levels, with options ranging from bronze to platinum packages. Each tier of membership offers a varying duration of access to the platform, giving members the chance to fully enjoy the benefits of their chosen package.

Here are the different One Off Member Plans available for accessing the BitsLab Database:

– The Bronze plan provides 7 days of access.

– The Silver plan provides 28 days of access.

– The Gold plan provides 186 days of access.

– The Platinum plan provides 365 days of access

Loyalty Member Plans

BitsLab offers a monthly subscription that provides customers with unlimited platform access until cancelled via direct debit. All plans are billed monthly.

Bits Lab Player Loyalty Member Plan – $8.66 per month ($2 per week)

Members get access to our Partner Discounts at stores Australia wide, member only Bits Lab promotion emails, 1 accumulating entry per promotion.

Bits Lab Player Loyalty Member Plan – $26 per month ($6 per week)

Members get access to our Partner Discounts at stores Australia wide, member only Bits Lab promotion emails, 5 accumulating entries per promotion.

Bits Lab Player Loyalty Member Plan – $43.33 per month ($10 per week)

Members get access to our Partner Discounts at stores Australia wide, member only Bits Lab promotion emails, 10 accumulating entries per promotion.

Loyalty Member Cancellation

To cancel your loyalty member plan, you must send an email to [email protected]. Once we receive your email, our team will send you a confirmation email to verify the cancellation request. If confirmed, we will proceed to cancel the direct debit request without giving any refund. However, please note that terminating your loyalty membership will not remove you from our mailing or text lists. You must unsubscribe through the associated links as they are sent via third parties. Please be aware that once you cancel your subscription, the payment provider will not allow reactivation of that subscription. This means that all accumulated history for that subscription will be lost. If you wish to continue your subscription, please follow the instructions in the notification emails or log in to the member’s dashboard to update your banking details.

Account Cancellation

By using the BitsLab service, you acknowledge and agree that you do not have any ownership rights over your Account and that BitsLab may terminate the Service at any time. Additionally, BitsLab reserves the right to cancel your Account and delete all of your Registration Information and User Content associated with your Account without prior notice, for any reason or no reason, including your violation of the terms and conditions. Please note that BitsLab will not be responsible for any damages or losses incurred due to the removal of User Content from the Site or Service. You have the option to cancel your Account at any time by contacting [email protected], and your cancellation will be effective once the administration has processed it. BitsLab also reserves the right to temporarily or permanently block access to the Site and/or Service for users whose Accounts have been cancelled.

Returns and Refunds

Your purchase of a Loyalty Member Plan or One Off Member Plan for our rewards platform supports BitsLab, and its partners. Loyalty member plans or one off member plans are refundable to an extent, dependant on circumstances.

You may cancel any membership or subscription at any time by notice in writing, with such cancellation to take effect once received by BitsLab. You are not entitled to any refund of any membership fees if you chose to cancel your service within any period of membership duration.

BitsLab’s goods and services come with guarantees that cannot be excluded under Australian Consumer Law.

If there is a problem or failure with the goods or a service, which can be considered minor, you have the right to have it rectified within a reasonable time and manner. In case of failure to do so, you have the right to request a refund for the goods and cancel the contract for the service. However, it’s important to note that refunds or rectifications cannot be given for reasons such as change of mind or failure to understand the product or service properly.

For major failures you are entitled to, request cancellation of your service contract with us, and a refund for the unused portion or compensation for the reduced value of the product, and or goods.

BitsLab Use Of Site and Service

By using the Site or Service, you agree to comply with all applicable laws and regulations. This includes refraining from violating anyone’s copyright, trademark, patent, trade secret, or other rights, and not infringing on anyone’s privacy or publicity rights. Furthermore, you agree not to launch any attacks, such as denial of service attacks, or otherwise disrupt the Site or Service. You must also refrain from attempting to gain unauthorized access to the Site, Service, or other users’ accounts or computer systems.

Additionally, you may not use the Site to create, store, or transmit any information that is defamatory, harmful, abusive, obscene, or hateful. You may not interfere with anyone else’s use of the Site or Service, engage in unsolicited commercial communication, engage in harassment, threaten others, harm children, or violate any laws, regulations, or ordinances.
